Print Manager Plus is a software based print management product that comes as a Basic, Standard or Premium Edition, which is licensed per printer audited. The product install changes nothing in the Windows infrastructure and relies only upon the standard Windows print subsystem. Larger Enterprises running Windows Cluster, Core Services, Terminal Services or CITRIX based networks are also fully supported.

The scalability of Print Manager Plus has been engineered for any size Workgroup, Network, or Enterprise. If you are a small business with only 2 printers or a business with a hundred users, or an entire enterprise with multiple locations and thousands of users and printers, Print Manager Plus can be easily installed and administered. Scalable to any size, it will audit, track, restrict, and secure your printing infrastructure.

End User License Agreement
PRINT MANAGER
A CALIFORNIA CORPORATION
Print Manager and Print Manager Plus

IMPORTANT-READ CAREFULLY: This Print Manager End-User License Agreement (“Agreement”) is a legal agreement between you (either an individual or a single entity) and Print Manager, a California corporation for the software product identified above, which includes computer software and associated media and printed materials, and may include “online” or electronic documentation (“Software”). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, promptly return the unused Software to the place from which you obtained it for a full return.

SOFTWARE LICENSE AGREEMENT:

This Software which includes upgrades and updates, is available only as an electronic download, and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold.

1. GRANT OF LICENSE.

This Agreement grants you the following rights:

a) Software and Support. You may install copies of the Software (including upgrades and updates) on as many computers, servers, etc., as you wish; however you are required to purchase a license for each printer audited by the Software.

b) You are entitled to support for one year from the date of purchase, and thereafter, during the period of any Maintenance License. Support includes upgrades, updates and assistance (either electronic, telephone or internet) during business hours 8-6PST.

c) License Pack. If you have acquired this Agreement in a Print Manager License Pack, you may use the Software to audit the maximum number of printers authorized on the printed copy of this Agreement, and may use each copy in the manner specified above.

d) Activation. The Software contains technological measures that are designed to prevent its unlicensed or illegal use. If you have any problem with the activation process, you should contact Print Manager customer support. The absence of any activation measures shall not be taken to mean that Print Manager consents to any use of the Software beyond the uses permitted in this Agreement.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

a) Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, modify, decompile, or disassemble the Software, except and only to the extent that the right to do so is allowed under applicable law.

b) Rental. You may not rent, lease or time-share the Software, or operate a service bureau facility for benefit of third parties, except and only to the extent that the right to do so is allowed under applicable law.

c) Software Transfer. You may permanently transfer all of your rights under this Agreement, provided you retain no copies, you transfer all of the Software (including all component parts, the media and printed materials, any upgrades, this Agreement, and, if applicable, the Certificate of Authenticity), and the recipient agrees to the terms of this Agreement. If the Software is an upgrade, any transfer must include all prior versions of the Software.

d) Termination. Without prejudice to any other rights, Print Manager may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the Software and all of its component parts.PO Box 209, Nevada City, CA 95959

3. UPGRADES.

If the software is an upgrade from another product, whether from Print Manager or another licensor or supplier, you may use or transfer the Software only in conjunction with that upgraded product, unless you destroy the upgraded product. If the Software is an upgrade of a Print Manager product, you now may use that upgraded product only in accordance with this Agreement. If the Software is an upgrade of a component of a package of software programs that you licensed as a single product, the Software may be used and transferred only as part of that single product package and may not be separated for use on more than one computer.

4. COPYRIGHT.

All title and copyrights in and to the Software (including but not limited to any images, photographs, animations, video, audio, music, text, and “applets” incorporated into the Software, and any copies of the Software) are owned by Print Manager or its licensors or suppliers. This Software is protected by copyright laws and international treaty provisions. Therefore, you must treat the Software like any other copyrighted material except that you may make a copy of the Software solely for backup or archival purposes. You may not copy the printed materials accompanying the Software.

5. US GOVERNMENT RESTRICTED RIGHTS.

The Software and documentation are provided with RESTRICTED RIGHTS and constitute commercial computer software developed entirely at private expense. Use, duplication, or disclosure by the Government shall be in accordance with FAR 52.227-19, Commercial Computer Software License, or other agency data rights provisions, as may be applicable and subject solely to restrictions as set forth in DFARS 227-7202. Manufacturer is Print Manager, a California corporation, PO Box 209, Nevada City, CA 95959.

6. EXPORT RESTRICTIONS.

Print Manager expressly complies with all export restrictions imposed by the government of the United States of America. You, agree not to export or re-export the Software to any country, person, entity or end user subject to U.S.A. export restrictions. Restricted countries currently include, but are not necessarily limited to Cuba, Iran, North Korea, Sudan, and Syria. You warrant and represent that neither the U.S.A. Bureau of Export Administration nor any other federal agency has suspended, revoked or denied your export privileges.

7. CONTROLLING LAW.

This Agreement shall be governed by the laws of the State of California, excluding its conflict of laws provisions. The exclusive venue for any dispute arising hereunder shall be a court of competent jurisdiction in San Mateo County, California, USA.. Should any of the provisions of this License be declared invalid by any court of competent jurisdiction, the balance of the License will remain in full force and effect.

8. LIMITED WARRANTY.

Print Manager warrants the a) the Software will perform substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt, and b) any hardware accompanying the Software will be free from defects in materials and workmanship under normal use and service for a period of one (1) year from the date of receipt. Some states and jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you. To the extent allowed by applicable law, implied warranties on the Software and hardware, if any, are limited to ninety (90) days and one year, respectively.

9. WARRANTY LIMITATIONS.

EXCEPT AS SET FORTH HEREIN, THE SOFTWARE (WHICH INCLUDES THAT OF ITS LICENSORS AND SUPPLIERS) IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. IN NO EVENT SHALL THE COPYRIGHT HOLDERS OR ANYONE DISTRIBUTING THE SOFTWARE BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES OR OTHER LIABILITY, WHETHER IN CONTRACT, TORT OR OTHERWISE, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE, EVEN IF A SOFTWARE REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU HEREBY ASSUME THE ENTIRE RISK OF ALL USE OF THE COPIES OF SOFTWARE COVERED BY THIS LICENSE.

10. CUSTOMER REMEDIES.

Print Manager, its licensors’ and suppliers’ entire liability and your exclusive remedy shall be, at Print Manager’s option, either a) return of the price paid, or b) repair or replacement of the Software or hardware that does not meet Print Manager’s Limited Warranty and which is returned to Print Manager with a copy of your receipt. This Limited Warranty is void if failure of the Software or hardware has resulted from accident, abuse, or misapplication. Any replacement Software or hardware will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.

11. NO OTHER WARRANTIES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRINT MANAGER, ITS LICENSORS AND SUPPLIERS DISCLAIM ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE SOFTWARE, AND ANY ACCOMPANYING HARDWARE, THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION.

12. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRINT MANAGER, ITS LICENSORS OR SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF PRINT MANAGER, ITS LICENSORS AND/OR SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Printers supported by Print Manager Plus are in the hundreds due to the method in which Print Manager Plus parses the actual spooled print language file that the printer hardware deciphers to actually print the job. This requires parsing separate print languages that the printer manufacturers write for their hardware, in turn allowing Print Manager Plus to track the data needed for a complete audit of all printing traffic and for any printer type.

Hard Quotas can be set on a single user or multiple users via user groups, and organizational units. Advanced (secondary Cash Quotas) quotas can also be set when charging for printing. Budgets can be set on User Groups, and Organizational Units, essentially setting a soft quota.
